LITCLUBBER AUTHOR AGREEMENT
Sets the conditions for requesting and using author features.
1. Introduction
Welcome to the LitClubber Author Program.
This Agreement governs the relationship between LitClubber and users who wish to publish literary works on the platform as authors.
Its purpose is to establish the rights, obligations, and responsibilities of both parties, ensuring a safe environment for readers and writers and protecting the intellectual property of published works.
This Agreement does not create an employment agreement, editorial representation, literary agency relationship, or commercial partnership between LitClubber and the author.
Economic conditions related to the sale of works through Golden Feathers are governed exclusively by the Author Monetization Agreement, which must be accepted separately when the author decides to monetize a work.
By accepting this Agreement, the author declares that they have read it in full and agree to be legally bound by its provisions.
2. Requirements to Become an Author
To publish works on LitClubber, the user must:
maintain an active account;
comply with LitClubber's Terms and Conditions;
complete the author verification process when required;
provide truthful information during that process;
accept this Agreement.
LitClubber may reject or cancel an application when there are reasonable grounds related to fraud, impersonation, breach of community rules, or any other circumstance that creates a risk for the platform or its users.
3. Intellectual Property
The author retains all copyright in the works they publish.
Publishing a work on LitClubber does not transfer intellectual property ownership to LitClubber.
All rights not expressly granted under this Agreement remain the exclusive property of the author.
4. License Granted to LitClubber
For the sole purpose of providing the services offered by the platform, the author grants LitClubber a license that is:
non-exclusive;
free of charge while the work remains published;
revocable according to this Agreement.
This license only authorizes LitClubber to:
store the work;
display it within LitClubber;
distribute it to readers according to enabled platform features;
generate backup copies.
This license does not authorize LitClubber to sell copyright, register the work as its own, or exploit it outside the services offered by the platform without a separate agreement.
5. Author Declarations
The author declares that:
they own the rights necessary to publish the work;
they have authorization to use any third-party content included in the work;
the publication does not infringe copyright, trademarks, image rights, or privacy rights of third parties;
the work is not plagiarism;
all information provided during verification is true.
If these declarations are false, the author will assume the corresponding legal responsibilities.
6. Responsibility for Content
The author is solely responsible for the content they publish.
LitClubber acts only as a hosting and distribution platform.
The author's responsibility includes, among other matters:
copyright;
accuracy of information;
images used;
illegal content;
defamation;
unauthorized use of third-party works;
third-party claims.
7. Permitted Content
Published works must comply with:
applicable law;
Community Rules;
Terms and Conditions;
this Agreement.
The publication of novels, short stories, tales, poems, essays, and other literary works is permitted.
Works may address historical, religious, political, social, or sexual themes when they have an artistic or literary purpose and do not violate LitClubber policies.
8. Prohibited Content
Works may not be published when their primary content includes:
pornography;
sexual exploitation of minors;
instructions for unlawful activities;
terrorism;
direct incitement to hatred;
real threats;
plagiarism;
malware;
fraud;
content whose publication is illegal.
LitClubber may also restrict other categories of content as the platform evolves.
9. Content Classification
The author is responsible for correctly classifying their works when the platform provides age-rating systems or content warnings.
Incorrect classification may be corrected by LitClubber.
10. Author Verification
LitClubber may request reasonable evidence to verify that a person controls the account from which they claim to be an author.
Verification does not constitute an absolute certification of the author's identity and does not guarantee the authenticity of all future publications.
11. Withdrawal of Works
The author may withdraw or delete a published work.
If the work was never monetized, LitClubber will provide a button that allows the author to delete the work or move it to draft status to remove it from publication.
Works subject to the Monetization Agreement may be subject to additional conditions related to rights previously acquired by readers.
12. Moderation
LitClubber may:
hide;
restrict;
unpublish;
suspend;
delete
a work when there are reasonable grounds to believe that it violates this Agreement, the Terms and Conditions, the Community Rules, or applicable law.
Whenever possible, LitClubber will seek to inform the author of the measure taken.
13. Third-Party Claims
If a third party submits a claim related to a work, LitClubber may:
temporarily suspend publication;
request information from the author;
require additional documentation;
permanently remove the work if the claim is substantiated.
14. Termination of the Author Program
The author may leave the Author Program at any time.
LitClubber may revoke author status when there is:
fraud;
impersonation;
serious breach;
repeat violations;
illegal activity;
abuse of the platform.
Termination will not affect pending obligations or rights previously acquired by third parties.
15. Changes to the Agreement
LitClubber may update this Agreement when necessary.
When changes are material, renewed acceptance will be requested before the author can continue publishing new works.
Previous versions will remain recorded for administrative and legal purposes.
16. Applicable Law
This Agreement will be governed by the laws of the Republic of Panama, without prejudice to mandatory consumer protection or intellectual property rules that may apply in other jurisdictions.
